Murder During Robbery Highlights Negligent Security Concerns

Robberies and violent crime are on the rise. Landowner’s owe their invitee’s(guest’s) a non-delegable duty to maintain their premises in a safe condition. That includes taking all appropriate safety measure’s to deter criminal activity on their premises. Some company’s take this obligation more seriously than others. As I previously wrote, Subway corporation is notorious for their poor attention to safety.

Fast food establishments, convenience stores, and restaurants are prime targets for robberies, and these robberies can lead to serious injuries including death.

Friday evening bartender at Josephine’s Restaurant in Boca Raton was killed and a waiter was pistol whipped when four men entered through a rear entrance after closing time and robbed lingering patrons, the owner and staff. Closing time is when most robberies occur. Accordingly, all doors should be locked, and provide limited entry and exit during closing time. The failure to have appropriate closing procedures is negligence.

Similarly, a client that we represent was shot and paralyzed during closing time at a Subway restaurant. In the video below you can see that the robber came in at closing time, and held up my clients. Unfortunately, Subway never their employees that reports should not be run at closing time, because running the reports disables the cash register. With the cash register disabled, my client(s) could not comply with the robber’s requests and were shot. One of my client’s was left paralyzed.
